This is a recently published study that details sexual harassment patterns in
junior and senior high schools in
America. The AAUW Educational Foundation is one of the largest sources of
funding for graduate women in the United States and abroad and commissions
groundbreaking research on educational equity.
Title VII of the Civil Rights Act of 1962 prohibits employment and workplace discrimination on the basis of race, color, religion, sex, and national origin.
Title IX, Education Amendments of 1972 from the U.S. Department of Labor details the prohibition of discrimination on the basis of sex in educational institutions, including exceptions to Title IX.
Gebseret Al v. Lago Vista Independent School District case from 1998 ruled that school districts are not liable under Title IX for teacher-student sexual harassment unless an employee with supervisory power over the offending employee actually knew of the abuse, had the power to end it, and failed to do so.
Oncale v. Sundowner Offshore Services case from 1998 determined that sex discrimination consisting of same-sex sexual harassment is actionable under Title VII. Men as well as women are protected under Title VII.

Revised Sexual Harassment Guidance: Harassment of Students by School Employees, Other Students, or Third Parties (issued January 2001). In accordance with Title IX, the U.S. Department of Education's Office for Civil Rights produced current detailed policy guidance regulations in order to provide educational institutions with the standards used by the Office of Civil Rights to investigate allegations of sexual harassment of students. Protecting Students from Harassment and Hate Crime: A Guide For Schools. In January 1999, the U.S. Department of Education's Office for Civil Rights published this document to provide elementary and secondary schools with practical guidance to help protect students from harassment and violence based on race, color, national origin, sex, and disability.
Sexual Harassment: It's Not Academic. This pamphlet, published by the Office for Civil Rights, is intended to provide school administrators, teachers, students, and parents with fundamental information to assist them in recognizing and dealing with sexual harassment.
